A cold war has broken recently between the government and the Supreme Court in Nepal. One or the other side may win this war, but the constitution, the due process of law and the Nepali people will be the ultimate losers in it. It is important to put the case in perspective to cut out the misinformation about it. The government promoted Deputy Inspector General Jaya Bahadur Chand as inspector general of police. His competitor Nawaraj Silwal went to the Supreme Court against the decision. The court quashed the decision, and the government appointed another DIG Prakash Aryal to the post. Silwal knocked the court s door with the second petition, which the court for examination. Angered by this, the ruling coalition directed its membersâ⬠¦show more contentâ⬠¦Similarly, the public is divided. In view of the widespread criticism, the government decided to put the motion on hold, and the Parliament decided to postpone its meetings until after the local elections due on 14 May 2017. But the debate continues unabated. Based purely on the constitutional provisions, I agree with those who blame the government for acting imperiously and for going after Karki to intimidate her and the judiciary as a whole so they would desist from holding it to account through judicial reviews of its decisions and follow-ups. Here are the provisions of the Constitution of Nepal 2015 relevant to this case: Article 101 (2): 1/4 members of parliament can move the motion of impeachment against the chief justice or justice of the Supreme Court if they fail to fulfill his their duties because of serious violation of this Constitution and law, incompetence or misconduct or failure and honestly or serious violation of the code of conduct. Section (6): Once the motion is moved, the chief justice or justice of the Supreme Court would not be able to discharge their duties. Article 103 (7) and (8): The legislature has the authority to punish anyone who undermines its privileges. However, defining hate as the basis for a crime is not as easy without possibly jeopardizing constitutional rights in the process. Hate crime laws generally add enhanced punishments to existing statues. A hate crime law seeks to treat a crime, if it can be demonstrated that the offense was a hate crime differently from the way it would be treated under ordinary criminal law. Hate Crimes are becoming more and more common in the United States. In a report released February 13, 2001, the FBI said 7,876 hate crimes were reported in the United State in 1999. The latest figures represent an increase over the 7,755 hate crimes reported in 1998, but the difference may not be significant because more agencies were reporting such crimes to the FBI in 1999. The figures are in the FBIââ¬â¢s Hate Crime Statistics, an annual publication. Seventeen people were murdered in incidents classified as hate crimes, compared to 13 in 1998. Of the total the 7,876 incidents, racial bias was associated with 54.5 percent of the cases, followed by religious bias at 17.9 percent, sexual bias at 16.7, percent ethnic bias at 10.5 percent and bias against the disabled at .24 percent. Also In summer at night when you go to sleep Just open the windows rather than turning on the A. C. ââ¬Ës, so there Is natural air, electricity is conserved and pollution of air by A. C. We can put things Like bottle in the bottle bank. NAS into save-a-can and give paper to the person who ND I can take is the one most people in the word have ignored. That is being vegetarian. Friends, at least we can be vegetarian we could reduce 51% of greenhouse gases. The step is weird and simple but very powerful. Going vegetarian indirectly reduce deforestation. Non-vegetarian people are the cause of 1/3rd deforestation of grass in the word. They cut forest for grazing animals and to make them health in order to produce good meat. Meat industry produces more carbon dioxide then all wordââ¬â¢s cars and rare planes. Also being vegetarian could expand our fife by 15 years, and could protect us from diseases like Swine Flu and Bird Flu. In you and l, some people are farmers. So the next point is for them. This merger had a positive impact on Kimberly Clark as it lead the company to increase its market share in the consumer market, as well as it gave the company a great product mix (ProQuest Information and Learning Company, 1995). This merger allowed expense reduction, along with operational synergies in the company and brought high end products as well as low end alternatives eliminating mid range segment. It strengthened Kimberly Clark Corporationââ¬â¢s position in the European market, by holding almost 58% of the Market share in Europe (Collins, 1995). Organisation Environments External Environment Political and Legal The merger between Kimberly Clark and Scott became a major legal and political issue in the market as Kimberly Clark had a control of 58% of the market share. This emerged as a domestic antitrust problem in the consumer mind in Europe (Collins, 1995). The direct target competition among them was bringing the consumers a lower price and also benefits from frequent promotions, couponing and other marketing strategies (United States District Court Northern District of Texas Dallas Division, 1995). Due to the reasons mentioned above, there was increased political pressure on Kimberly Clark which lead them to sell SCA (Kleenex plant in Britan). This plant used to help thier tissue brand Kleenex to be more improved and advanced. Later, SCA began competing with Kimberly Clark leading to a fall in the share of Kimberly Clark by about 3% and gain in the share of SCA by 6% (Forest Dawley, 1998). Economical The merger between Scott and Kimberly Clark brought Kimberly Clark a major restructuring cost falling in between $675 million and $775 million. However, the merger did not show any rapid growth in the performance of the company as expected from the policy. Kimberly Clark faced several challenges such as improper organisation structure and poor planning which led to their fall in market share. This also led to the loss of trust from the share holders in the company. Improper evaluation of capital involvement in the merger and strategies to reduce the operational cost of the company reflects on the poor performance of the company.
